CLEVELAND – Can I recover for a hostile work environment?

Everyone knows someone who has to suffer a horrible work atmosphere. However, under Ohio law it may be possible to bring an action for having experienced a hostile work environment. In general, to bring a successful claim, one must show: (1) that he or she was in a protected class – whether it is based on age, race, gender or other considerations; (2) that he or she was subjected to unwelcomed verbal or physical conduct; (3) that he or she was harassed by such unwelcomed verbal or physical conduct; (4) that the alleged harassment had the effect of unreasonably interfering with work performance and created an intimidating, hostile, or offensive environment; and (5) that an employer-employee relationship exists.
